Particulars of Claim
- Legal Procedure
The particulars of claim is the formal document setting out the factual and legal basis of the claimant's case, including the nature of the claim, the facts relied upon, and the remedy sought. Under CPR Part 16, they must contain a concise statement of the facts and, where relevant, details of any interest claimed. They may be included in or served separately from the claim form.
In practice
Particulars of claim must be verified by a statement of truth. They must be served within 14 days of service of the claim form if not included with it. Defective particulars may be struck out under CPR 3.4 if they disclose no reasonable grounds for bringing the claim. The defendant's time for filing a defence runs from service of the particulars, not from service of the claim form.
