Adverse Possession

  • Property

The acquisition of title to land by occupying it without the owner's consent for a prescribed period. For registered land, the squatter may apply for registration after 10 years of adverse possession. The registered proprietor then has 65 business days to object.

In practice

Adverse possession rarely arises directly in enforcement proceedings, but it can affect a debtor's property interests. If a debtor claims an interest through adverse possession, the creditor must verify whether the claim has been registered. Unregistered adverse possession claims may complicate charging order applications.
