Entry Hours
- Debtor Rights
The hours during which an enforcement agent is permitted to enter a debtor's premises. Under the Taking Control of Goods Regulations 2013, enforcement agents may only enter residential premises between 6am and 9pm. Different rules may apply to commercial premises.
In practice
Entry outside permitted hours is unlawful and any goods taken may need to be returned. For commercial premises, there is more flexibility if the premises are open for business outside these hours. An enforcement agent who has already lawfully entered premises before 9pm may remain after 9pm to complete the enforcement action in progress, but cannot make a new entry after the permitted hours.
