Notice of Enforcement

  • Enforcement Methods

A written notice that must be given to a debtor before an enforcement agent can take control of goods. The notice must give at least 14 clear days before enforcement can commence and must contain prescribed information including the debt amount, creditor details, and the debtor's rights.

In practice

The notice of enforcement is the first contact the debtor receives from the enforcement agent. It is sent during the compliance stage, and the compliance fee of £79 is recoverable from this point. If the debtor pays the full amount (including the compliance fee) within the seven-day notice period, no further fees are incurred. The notice must comply with the prescribed form in the Taking Control of Goods Regulations 2013.
