Controlled Goods Agreement
- Enforcement Methods
A written agreement between an enforcement agent and a debtor under which the debtor acknowledges that their goods are bound and undertakes not to remove or dispose of them. It replaced the old walking possession agreement under the Taking Control of Goods Regulations 2013.
In practice
When an enforcement agent attends and identifies goods of sufficient value, they will typically enter into a controlled goods agreement rather than immediately removing the goods. This allows the debtor to continue using the goods while making payment arrangements. If the debtor breaches the agreement by disposing of goods or failing to pay, the agent can return and remove the goods without further notice.
