Walking Possession
- Enforcement Methods
A historical term referring to the arrangement where an enforcement agent claimed possession of a debtor's goods but left them on the premises. Under the Taking Control of Goods Regulations 2013, this concept has been replaced by the controlled goods agreement.
In practice
The term "walking possession" is still widely used in the enforcement industry despite its replacement by the controlled goods agreement. Under the old law, the bailiff would leave the goods with the debtor under a walking possession agreement. The modern equivalent, the controlled goods agreement, achieves the same practical outcome but with clearer statutory footing and debtor protections.
