Enforcement Fee Stage
- Fee Terms
The second stage of the fee structure under the Taking Control of Goods (Fees) Regulations 2014, triggered when an enforcement agent attends the debtor's premises or takes control of goods. Under Table 1, the fee is £247 plus 7.5% of the amount over £1,900. Under Table 2 (High Court), Stage 1 is £200 plus 7.5% over £1,200, and Stage 2 is £520.
In practice
For High Court writs, the enforcement stage is split into two parts. Stage 1 (£200 plus 7.5% over £1,200) applies when a controlled goods agreement is entered into. Stage 2 (a further £520) is triggered if no agreement is made or the agreement is breached. Under Table 1, there is a single enforcement stage. All percentage fees are calculated on the sum outstanding, and under regulation 7(c) any fraction of £1 in the percentage fee is reckoned as £1 and any fraction of a penny is disregarded.
