Exceptional Disbursement

  • Fee Terms

An unusual or extraordinary cost incurred during enforcement that falls outside the scope of ordinary disbursements. The enforcement agent must apply to the court for permission to recover exceptional disbursements from the debtor.

In practice

Court approval is required because exceptional disbursements can be significant: examples include specialist removal equipment for heavy or unusual goods, veterinary fees for livestock, and costs of dealing with hazardous materials. The agent must show that the cost was necessary and reasonable in the circumstances. Without court approval, the cost falls on the enforcement agent or creditor.
