Foreign Judgments (Reciprocal Enforcement) Act 1933

  • International

An Act providing for the registration and enforcement of judgements from countries with which the UK has bilateral reciprocal enforcement treaties. The FJREA 1933 offers a more modern framework than the AJA 1920 and applies to judgements from a different set of countries, including several European states and Commonwealth nations.

In practice

Under the FJREA 1933, a judgement creditor applies to the High Court to register the foreign judgement within six years. Once registered, the judgement has the same force as an English judgement. The debtor may apply to set aside registration on grounds including fraud, jurisdictional error, or that the judgement is not yet final. The Act applies to countries designated by Order in Council.
