Registration of Judgement

  • International

The process by which a foreign judgement is registered in the courts of England and Wales so that it can be enforced as if it were a domestic judgement. Registration is the primary mechanism under the AJA 1920, FJREA 1933, and the Hague Convention 2019 for giving effect to foreign judgements.

In practice

The creditor applies to the High Court with a certified copy of the foreign judgement, evidence of the amount outstanding, and proof that the judgement is enforceable in the country of origin. Once registered, the creditor can use all standard English enforcement methods: writs of control, charging orders, third party debt orders, and attachment of earnings. The debtor has a limited window to challenge registration.
