Money Judgement

  • Court Orders

A money judgement is any court order requiring one party to pay a specified sum of money to another. It is the foundational order upon which all debt enforcement methods are built. Money judgements may be obtained in the County Court, High Court, or certain tribunals, and they accrue interest at the statutory rate of 8% per annum under the Judgments Act 1838.

In practice

A money judgement can be enforced through multiple methods: writ or warrant of control (seizure of goods), charging order (security over property), third party debt order (diverting money owed to the debtor), attachment of earnings, or insolvency proceedings. The choice of enforcement method depends on the debtor type, amount, and known assets. Judgements are enforceable for six years from the date of judgement under the Limitation Act 1980.
