Notice on Title
- Property
An entry in the charges register at the Land Registry that alerts anyone searching the title to the existence of an interest affecting the property. Unlike a restriction, a notice does not prevent registration of a dealing but ensures the interest is not overridden by a purchaser.
In practice
Notices are used to protect various interests including charging orders, home rights under the Family Law Act 1996, and contractual rights. A creditor with a charging order may enter either a notice or a restriction depending on the circumstances. The notice ensures that any purchaser takes subject to the charge.
