Restriction on Title
- Property
An entry in the proprietorship register at the Land Registry that prevents or regulates the registration of a dealing with the land. Restrictions are used to protect charging orders and other interests by ensuring that proceeds of sale are directed to the charge holder before completion can be registered.
In practice
After obtaining a final charging order, a creditor applies to enter a restriction on the debtor's title. This ensures that the property cannot be sold or transferred without the charging order being satisfied or the creditor being notified. The standard Form K restriction is the most commonly used form for protecting charging orders.
