Trespass

  • Property

The unauthorised entry onto or interference with another person's land. Trespass to land is a civil wrong actionable without proof of damage. In enforcement, questions of trespass arise when enforcement agents exercise powers of entry under the Taking Control of Goods Regulations 2013.

In practice

Enforcement agents have statutory powers of entry for certain types of enforcement, but these powers are limited. Entry must be at a reasonable hour (between 6am and 9pm), and agents must not use force to gain first entry to residential premises for most debt types. An agent who exceeds their powers of entry may be liable for trespass.
