Certificated Enforcement Agent
- Regulatory Bodies
An individual who holds a certificate issued by a County Court judge under the Certification of Enforcement Agents Regulations 2014, authorising them to take control of goods under Part 3 of the Tribunals, Courts and Enforcement Act 2007. Certification requires passing an examination and satisfying a fit and proper person test.
In practice
Certificated enforcement agents are employed by High Court Enforcement Officers, local authorities, and private enforcement companies. They attend debtors' premises, serve notices of enforcement, take control of goods, and manage controlled goods agreements. The certificate must be renewed every two years, and agents working for firms accredited by the Enforcement Conduct Board are subject to its complaints process.
